Terms of Sales
Article 1: Scope of application
These General Conditions of Sale apply to all orders placed through the website www.loia.studio. The customer acknowledges having read these General Conditions of Sale and accepts their terms.
In a case not covered by these General Conditions of Sale, the distance selling rules of the place where the company is headquartered apply.
Article 2: Orders
LOIA undertakes to accept orders placed via the Internet under the terms of these General Conditions of Sale and within the limits of available stocks.
By validating the order, the customer declares to have read and accepted these General Conditions of Sale.
Any order will only be taken into consideration after receipt of payment and will be confirmed by LOIA by an order confirmation email.
LOIA reserves the right to cancel all non-compliant or doubtful orders, as well as those from a customer with whom there is any dispute.
All orders placed on the LOIA site must have been made by an adult or a person representing a minor; if the buyer is not over eighteen (18) years old.
Article 3: Price
The prices indicated are expressed in euros (EUR) and are inclusive of all taxes (applicable VAT, excise duties and all other applicable taxes). The prices indicated also include participation in the eco-tax.
LOIA reserves the right to change the prices indicated on the LOIA.STUDIO website at any time.
Article 4: Shipping costs
Shipping costs are free on the LOIA website for all orders over 100 euros including tax ( delivery to your home ). For any order less than 100 euros including tax, the shipping costs are 4.90 euros including tax (delivery to your home). These conditions are valid for all deliveries in mainland France and Corsica. LOIA reserves the right to request a contribution to shipping costs. For all orders placed outside mainland France and Corsica, shipping costs are payable and depend on the geographical area.
Article 5: Delivery and tracking of your order
LOIA delivers in France and abroad (see the pricing conditions in article 4 dedicated to Shipping costs).
The delivery time for orders is indicated in working days on the product technical sheet. Non-working days include Saturdays, Sundays and public holidays, as well as days when road transport is prohibited.
The order is delivered to the delivery address chosen by the Customer.
The Customer is required to carefully check his packages upon delivery in order to immediately raise any reservations with the carrier. The customer must refuse delivery to the carrier if the package shows visible damage resulting from transport. Please refer to Article 6: Return Policy / Guarantee, section “In the event of a problem during your delivery” for more information.
Article 6: Return Policy / Exchanges / Guarantee
In application of the provisions of article L.121-16 of the Consumer Code, the buyer has a period of fourteen (14) clear days from delivery of his order to return the delivered item. for exchange or refund, at the buyer's choice, without penalties except return costs.
Before any return, LOIA must be informed in advance by email to loia@loia.studio.

The product must be returned in its original, intact packaging, have not suffered any damage and be returned in its entirety. It is important not to tape anything directly to the product packaging so as not to damage the product packaging. The return must absolutely be carried out using suitable additional packaging.
Please note that you are responsible for the product until it has been received and accepted by LOIA. Returns which do not comply with LOIA conditions cannot be accepted and will not be refunded.
If the Customer complies with the terms set out above, then LOIA gives itself a maximum of fourteen (14) days to reimburse the Customer via a predefined reimbursement method with the Customer.
Please note that reconditioning costs may be applied depending on the condition of the packaging and the wear/use of the returned product and/or accessory(s), thus being subject to a partial refund.
In case of exchange:
If you wish to exchange a product for another color, please place a new order, having taken care to return the product originally purchased. The refund for the product originally purchased will be made after receipt and validation of LOIA.

In the event of a technical problem / product warranty:
If there is a problem with your product, we invite you to contact our After-Sales Service by email at loia@loia.studio. Following our contact, we will do everything possible to repatriate your product. Please note that return costs are exclusively your responsibility.
If the product is declared defective under normal conditions of use, then the warranty covers the repair of the device or the exchange for a new product (depending on the brand's diagnosis). If necessary, we will return the repaired or new product at our expense.
If the product failure is not subject to our manufacturer's warranty, then we will not be able to replace or reimburse your product.
In the event of a problem during your delivery:
You are required to carefully check your packages upon delivery in order to immediately raise any reservations with the carrier. If you notify the slightest problem, you have the right to refuse delivery of the package to the carrier.
After receipt of your items, you have forty-eight (48) working hours to send a registered letter with acknowledgment of receipt to the carrier. You will need to precisely describe the damage observed. Also remember to attach a copy of the transport voucher on which you have made specific reservations.
Characterized reservations, in the same way as any other formality provided for by article L. 133-3 of the Commercial Code, are necessary to assert the rights of the sender, the buyer or the recipient against the carrier. Remember to check your packages carefully and express your reservations on the transport voucher.
In the event of a packing error on our part:
If you receive a product that does not conform to that ordered via the LOIA site, we will repatriate and send the ordered product at our expense. In this case, please contact us upon receipt of your order by email at loia@loia.studio.
Article 8: Payment
Payment for products purchased from LOIA is payable in full upon ordering.
Payments are made by credit card.
We accept payments by Visa, MasterCard, Carte Bleue, Electron… When paying, you will be asked for your identity, your bank card number, the expiry date and its cryptogram.
Depending on your bank, you will need to complete a final step to validate the online payment.
We do not store the bank card numbers used during transactions.
Article 9: Reservation of ownership
In accordance with the law of May 1, 1980, the products delivered to the customer are sold subject to retention of title. The transfer of ownership is subject to full payment of the price of the products by the customer, on the due date agreed between the parties.
In the event of non-payment of the total price of the goods on the agreed due date, RetroFutur may claim ownership of the products at the customer's expense and risk.
Article 10: Personal data
Membership of the LOIA.STUDIO site requires the client to communicate a certain amount of personal data concerning him or her.
This data necessary for processing the order and managing LOIA.STUDIO's commercial relations with its customers is secure, kept confidential and is not subject to any commercial use by third parties.
In accordance with Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms, the consumer has the right to access and rectify any personal information concerning him.
Article 11: Applicable law
The language of this contract is French. All clauses of these General Conditions of Sale, all transactions and purchasing operations carried out from the LOIA.STUDIO site are governed by French law. Any dispute which has not been resolved amicably will be the responsibility of the Courts of the head office of the Retrofutur.fr Company or of the court of the department chosen by the customer.
